AGREEMENT TO TERMS

These Terms & Conditions constitute a legally binding agreement made between you ("you") and Mad Made It, operated by Madison D'Avella ("Mad Made It," "we," "us," or "our"), concerning your access to and use of the Mad Made It website, including www.shopmadmadeit.com, as well as any other media form, media channel, or online store related, linked, or otherwise connected thereto (collectively, the "Site").

By accessing or using the Site, or purchasing a product through the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with these Terms & Conditions, please do not use the Site or purchase products through it.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms & Conditions at any time. We will update the "Last updated" date when changes are made. Your continued use of the Site after revised Terms & Conditions are posted means that you accept those changes.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction where doing so would violate applicable laws or regulations. Those who access the Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and all content contained on it, including text, photographs, graphics, logos, product photography, designs, illustrations, videos, and other materials (collectively, the "Content") are owned by or licensed to Mad Made It and are protected by applicable copyright, trademark, and other intellectual property laws.

The Content is provided for your personal, non-commercial use. Except as expressly permitted by these Terms & Conditions, you may not copy, reproduce, modify, distribute, sell, publish, or otherwise exploit any Content from the Site without our prior written permission.

You may view and access the Site and download or print reasonable portions of the Content for your personal, non-commercial use.

All rights not expressly granted to you are reserved by Mad Made It.

PRODUCTS AND HANDMADE ITEMS

Mad Made It creates handmade pieces using vintage and pre-loved fabrics and materials sourced from thrift stores, community markets, and similar sources.

Because our products are handmade using vintage and pre-loved materials, no two pieces are exactly alike. Items may contain natural variations, signs of previous use, minor imperfections, differences in texture, color, pattern, or other characteristics associated with vintage and pre-loved textiles.

These characteristics are part of the nature and character of the materials and are not necessarily considered defects.

We make reasonable efforts to accurately display product colors, measurements, materials, and details on the Site. However, colors may appear differently depending on your device or screen, and measurements may vary slightly due to the handmade nature of our products.

Because our materials are sourced from vintage and pre-loved textiles, fabric availability is limited. We cannot guarantee that a particular fabric, material, pattern, or color will be available again.

PRODUCT AVAILABILITY

Products are offered in limited quantities and may sell out at any time.

We reserve the right to limit quantities, refuse orders, or discontinue products at any time and for any reason.

We make reasonable efforts to ensure that product descriptions, pricing, and availability are accurate. However, errors may occasionally occur. If we discover an error in the price or description of a product you have purchased, we will contact you and provide you with the option to confirm the purchase at the correct information or cancel the order.

ORDERS AND PAYMENT

When you place an order through the Site, you agree to provide current, complete, and accurate information necessary to process and fulfill your purchase.

We accept the payment methods made available through our online checkout.

All prices are listed in U.S. dollars (USD) unless otherwise stated. Applicable sales tax and shipping charges will be added to your order where required.

By submitting an order, you authorize the applicable payment provider to charge your selected payment method for the total amount of your purchase.

We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, errors in product or pricing information, or circumstances that prevent us from fulfilling the order.

SHIPPING AND DELIVERY

We will make reasonable efforts to process and ship orders within the timeframe stated on the Site.

Once an order has been shipped, delivery times may vary depending on the shipping provider, destination, weather, and other circumstances outside our control.

Mad Made It is not responsible for delays or damage caused by shipping carriers, customs, weather, incorrect addresses provided by the customer, or other circumstances beyond our reasonable control.

You are responsible for providing an accurate shipping address at checkout. If you provide an incorrect address and your order is returned or requires reshipment, you may be responsible for additional shipping costs.

RETURNS, REFUNDS, AND EXCHANGES

Because each piece is handmade and produced in limited quantities using vintage and pre-loved materials, Mad Made It does not offer refunds or returns for change of mind, incorrect sizing, or other personal preference reasons.

Please carefully review the measurements, materials, product descriptions, and photographs before placing your order.

If you have questions about an item, including its measurements, materials, or fit, please contact us before purchasing and we will be happy to help.

If you believe your item arrived damaged, defective, or materially different from the product described on the Site, please contact us at customs.madmadeit@gmail.com as soon as possible after receiving your order. We will review the issue and determine an appropriate resolution where applicable.

Nothing in these Terms & Conditions is intended to limit any rights or remedies you may have under applicable consumer protection laws.

PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than the purposes for which we make it available.

As a user of the Site, you agree not to:

  1. Use the Site for any unlawful or unauthorized purpose.

  2. Attempt to gain unauthorized access to any portion of the Site or its systems.

  3. Use automated tools, bots, scrapers, or other means to collect information from the Site without our permission.

  4. Copy, reproduce, modify, distribute, or commercially exploit our Content without our written permission.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Pennsylvania, United States, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms & Conditions or your use of the Site shall be subject to the applicable courts located in Philadelphia, Pennsylvania, unless otherwise required by applicable law.

CORRECTIONS

There may occasionally be information on the Site that contains typographical errors, inaccuracies, or omissions, including information relating to product descriptions, pricing, availability, shipping, or other details.

We reserve the right to correct errors, inaccuracies, or omissions and to update information on the Site at any time without prior notice.

DISCLAIMER

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW.

PRODUCTS ARE HANDMADE USING VINTAGE AND PRE-LOVED MATERIALS. VARIATIONS IN COLOR, TEXTURE, PATTERN, CONDITION, AND OTHER CHARACTERISTICS MAY OCCUR AND ARE PART OF THE NATURE OF THESE MATERIALS.

NOTHING IN THESE TERMS & CONDITIONS EXCLUDES OR LIMITS ANY RIGHTS OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, MAD MADE IT, MADISON D'AVELLA, AND OUR AFFILIATES, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS THROUGH THE SITE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS & CONDITIONS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Mad Made It, Madison D'Avella, and our affiliates, service providers, and representatives from and against claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

  2. Your violation of these Terms & Conditions.

  3. Your violation of applicable law.

  4. Your infringement of the rights of another person or entity.

We reserve the right to assume the exclusive defense of any matter for which you are required to indemnify us, and you agree to cooperate with that defense.

We may collect and maintain certain information relating to your use of the Site and your purchases. Our collection and use of personal information is described in our Privacy Policy.

By using the Site, you acknowledge that you have reviewed our Privacy Policy.

ELECTRONIC COMMUNICATIONS

Visiting the Site, placing an order, completing online forms, and communicating with us electronically constitute electronic communications.

You consent to receive communications electronically, including order confirmations, shipping notifications, customer service communications, and other notices relating to your transactions.

You agree that electronic communications satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.

These Terms & Conditions and any policies posted on the Site constitute the entire agreement between you and Mad Made It regarding your use of the Site and purchase of products.

Our failure to enforce any provision of these Terms & Conditions does not constitute a waiver of that provision.

If any provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

Nothing in these Terms & Conditions creates a partnership, joint venture, employment, or agency relationship between you and Mad Made It.
